Prevailing Wage Override Sets Up Legal Brawl | New York Daily News

Setting the stage for a major legal battle, the City Council on Tuesday overrode Mayor Bloomberg's veto of its ?prevailing wage? bill.

?This bill has been narrowly tailored to affect only direct recipients of city financing,? said Council Speaker Christine Quinn before the vote. ?If a business isn?t looking for taxpayer dollars they are under no obligation to meet the requirements of this bill.?

The legislation -- which Bloomberg has vowed to take legal action against -- would raise pay for hundreds of service workers at some 41 buildings that receive city tax breaks. Their salary increases would be determined by the city comptroller?s prevailing-wage scale.

Hizzoner has repeatedly slammed the bill.

?In this day and age, this is not appropriate legislation if we want to get companies to come here,? he told reporters at an unrelated event Tuesday.

?It is just not the right piece of legislation," Bloomberg said. They should have looked in a mirror before they voted for it. They should have looked in a mirror before they overrode it. And we believe we will prevail in court and it will not go into effect.?

The override passed 44 to 4, far more than the two-thirds required. The Council?s three Republicans voted against it as well as Queens Democrat Peter Vallone Jr.

Under the legislation, repairmen and cleaners at major office buildings whose pay is now governed under the Comptroller?s Office wage scale earn $24.74 per hour, or roughly $50,000 a year. Workers covered under the bill would get a pay increase of 35% to 45%, labor backers said.

It may be a while before that happens: Barring the expected protracted legal fight, the local law would not even take effect for about six months, a city Law Department spokeswoman said.
