Chelsea owner Abramovich faces $6 billion court ruling
LONDON (Reuters) - Chelsea Football Club owner Roman Abramovich will find out on Friday whether he owes his former partner Boris Berezovsky as much as $6 billion (3.8 billion pounds) after a British court battle that has laid bare the post-Soviet carve-up of Russia's vast natural resources.
After a legal odyssey stretching from the gilded corridors of the Kremlin to the offshore enclaves favoured by Russia's richest tycoons, Judge Elizabeth Gloster will rule on whether Berezovsky was extorted out his business empire by Abramovich.
Berezovsky, a fast-talking former mathematician who became a Kremlin powerbroker under late President Boris Yeltsin only to fall foul of Vladimir Putin, says Abramovich used the threat of Kremlin retribution to intimidate him into selling out of Russia's fourth biggest oil company at a knockdown price.
Abramovich, the world's 68th richest man with a $12.1 billion fortune, denies that and says he merely paid Berezovsky money for political cover and protection - known in Russian bandit slang as "krysha" or "roof".
"I am a genetic optimist but I shall not say anything more until we see the verdict," Berezovsky told Reuters by telephone on Tuesday.
Judge Gloster will spend about an hour reading out a summary of the decision at the High Court's modern Rolls Building, starting at 10:30 a.m. on Friday. The final judgment will be published after September 17.
Abramovich spokesman John Mann declined to comment until the ruling was handed down, though either party could appeal in the case, which has cost tens of millions of pounds in legal fees.
Besides the personal drama of a public battle between two of Russia's most dazzling businessmen, one of the biggest private litigation cases in the world has detailed the treacherous business world of post-Soviet Russia:
Ownership means nothing, offshore cash is king and while Yeltsin granted favoured tycoons control over the oil and metals producers of a former superpower, President Putin can wrestle assets back from errant oligarchs no matter how powerful.
RUSSIAN KRYSHA
Complete with blatant tax evasion, informal deals on billion-dollar assets and a fly-on-the-wall view from inside the adrenaline bubble of Russia's A-team of oligarchs, the case reveals the country's heady corruption.
Even the evidence reads like a John le Carre thriller: barristers bickered over handwritten notes from an offshore lawyer who died in a mysterious helicopter crash, a snatched conversation on tax avoidance recorded in secret at Le Bourget airport and a meeting at London's Dorchester Hotel to hash out the creation of the world's biggest aluminium company.
"The most interesting part of it is the light it sheds on the way in which Russian business was done at that very high level in the immediate post-Communist period: This culture of krysha and payments being paid back and forward," said Philippa Charles, a litigation partner at law firm Mayer Brown, which is not directly involved in the case.
"Meetings at heliports, alpine ski resorts - it is all rather James Bond but actually it shows this was the reality of how business was done at that time in Russia," Charles said.
The focus of the case was 1995 - the year Yeltsin sold off the assets of a former superpower to a handful of influential traders who became known as the oligarchs.
Rich beyond the dreams of their often modest Soviet childhoods, the barons of Siberia came to personify the corruption of post-Soviet Russia: brash, dangerous alpha-males who scorned the rules of mortals.
After meeting on a Caribbean yacht trip organised by fellow tycoon Pyotr Aven, Berezovsky and Abramovich, then a 28-year-old oil trader, came up with a simple idea: merge Russia's best refinery with some of the top oil and gas fields of Siberia.
But to pull it off, they would need Yeltsin's support.
OLIGARCH BATTLES
Berezovsky said Abramovich agreed to give him and partner Badri Patarkatsishvili, a chain-smoking Georgian who died in Britain in 2008, a half share of what would become Sibneft to secure state approval for its creation and privatisation.
Abramovich disputes that, saying he merely paid Berezovsky for providing political cover and protection culminating in a final payment of $1.3 billion via a sheikh in 2001. Abramovich said Berezovsky did nothing to develop Sibneft.
"Krysha was required. It was impossible to keep hold of the company without krysha. So we required both political and physical krysha," Abramovich told the court.
After fleeing Putin's Russia in 2000, Berezovsky claims Abramovich sought to curry favour with Putin by threatening him with expropriation unless he sold his Sibneft stake to him.
Russia's state gas monopoly Gazprom bought Sibneft from Abramovich for $13 billion in 2005. Abramovich denies any threats were made.
Berezovsky also claimed Abramovich sold his shares in RUSAL Plc, the world's top aluminium producer, without his permission. He is seeking over $5 billion for his claimed losses over Sibneft and over $564 million for RUSAL.
"There is no suggestion that anyone forced or pressured Mr Abramovich into acting for the Kremlin," Berezovsky told the court. "He was simply happy to act to the detriment of his friend and partner in order to curry favour with President Putin."
Abramovich's lawyers cast Berezovsky as an obsessive man angry at the success of Abramovich who he believed enjoyed a similar level of clout with Putin -- Russia's paramount leader since December 31, 1999 -- as Berezovsky enjoyed with Yeltsin.
If after digesting the intricacies of Russian business practise, the judge rules against Berezovsky, his reputation as a publicity seeking former oligarch will be cemented.
But if Berezovsky wins, Putin will be cast as Russia's alpha-dog ruler whom even billionaire oligarchs such as Abramovich are so keen to please that they will betray their former partners.

Fungi help create Amazon clouds and rain
In the Amazon rain forest, salty particles from spore-launching fungi help make clouds and rain, according to new research.
The tiny, potassium-rich specks, smaller than bacteria, waft above the forest into the air. Once in the atmosphere, organic gases condense on the particles, coating them with gel-like compounds. The coated particles provide a surface for water vapor to form cloud droplets and rain.
"To form rain, you need a surface (that) water can condense on. The biosphere of microorganisms and plants are releasing particles that are triggering the rain," said lead researcher Christopher P?hlker, a doctoral student at the Max Planck Institute for Chemistry in Mainz, Germany.
The new study, detailed in Friday's issue of the journal Science, suggests the Amazonian rain forest ecosystem is coupled in a feedback system, with climatic conditions above influenced by plants below and vice versa, the researchers said.
Pristine air
The Amazon River basin is home to the largest rain forest on Earth, covering about 2.67 million square miles (6.9 million square kilometers) in seven countries.
The remote site where the study took place has "pristine" air during the rainy season, P?hlker told OurAmazingPlanet.com. With clean air blown in from the ocean and rain washing out pollutants, there is almost no evidence of human activity. Studying clouds and climate cycles there is like looking back in time, and provides a reference point for understanding how humans affect climate. "We're particularly interested to learn how clouds and climate worked before humans started polluting," P?hlker said. [ 10 Most Pristine Places on Earth ]
However, even pristine air contains organic gases (from plants) and particles. A forest biosphere like the Amazon releases thousands of different molecules every day ? they're responsible for its rich smell. When volatile organic gases like terpene, which gives lemons their citrusy smell, loft into the atmosphere, they are oxidized by chemicals such as ozone. The transformed gases then condense into particles, forming aerosols. (Aerosols are particles suspended in a medium like air or water.)
Until now, scientists "did not understand how these organic molecules form particles, especially in the rain forest," P?hlker said.?
Plant-air interactions
The researchers analyzed atmospheric particles collected atop a 262-foot-high (80 meters) tower in the rain forest. They found three kinds of aerosol particles, each with surprisingly high potassium levels. P?hlker examined the internal structure of the particles, which are nanometer-to-micrometer in size. (There are 1 billion nanometers and 1 million micrometers in each meter.) He found they had a salty, potassium-rich core covered by gel-like volatile organic compounds.

The most likely source of the potassium specks are fungi, which use potassium-laden water to launch their spores, but other plants make the salts, too. "There are still a lot of studies to do to find the fungal species that are the most likely sources, and figure out the mechanisms and the amounts (of salt) released," P?hlker said.
Atmospheric chemist Delphine Farmer said she would like to know what happens to the potassium-cloud cycle once human pollutants such as nitrogen and sulfur are in the atmosphere. "There are some interesting questions about how important this is when you start having perturbations from human activities," said Farmer, a professor at Colorado State University in Fort Collins, who was not involved in the study.
"It's a really interesting study and it raises some new questions about the role of plant-based emissions," she said. "This is a new perspective on biosphere-atmosphere interactions."

Eddie Van Halen has undergone emergency surgery for "a severe bout of diverticulitis," Van Halen posted on its?website, and will spend the next four to six months recovering. As a result, the rockers are rescheduling a tour of Japan that had been slated for November. "The band looks forward to seeing and playing for their fans in 2013," read a brief statement.
Diverticulitis is a digestive disease that occurs when pouches of the inner lining of the intestine, most often in the colon, become inflamed or infected. Symptoms include nausea, vomiting, fever and cramping.
Van Halen also canceled a series of dates earlier this summer. Although there was talk at the time that the musicians weren't getting along, singer David Lee Roth said in a videothat the group had simply?"bit off more than we could chew," a sentiment Eddie Van Halen echoed in an interview.
The band this year released "A Different Kind of Truth," Van Halen's first album with David Lee Roth in 28 years.

teenagers on holiday and french peach tarts - my french country home
Our short break in the South was spontaneous, hilarious and exactly what I needed after a long summer and before a busy fall.
This holiday was meant to be.... as a few days before our leaving date, a huge house materialised, complete with a ton of bedrooms, a pool, space for the dogs to run around, easy access to a sleepy little village and bikes for everyone.? For a week we forgot about internet (well almost) forgot about the news, practically forgot about the car, and wandered from pool to table to river to pool to table in a happy haze.If you are feeling weary, I can recommend no better remedy than heading off with a bunch of youngsters aged between 15 and 21.?
Why was it such a good idea to holiday with teenagers???
Because they just wanted to relax.?
They liked to smile and laugh the whole time.??
They were not picky - about anything!?
They got up late, which meant I could have a first breakfast and cup of tea alone on the terrace MMMM....
They listened to a most eclectic selection of music, and the house was filled with?
jazz, rap, reggae, rock and classical airs all day long
They let me beat them at cards and at tennis! (OK so they are very polite kids)
and whatever I put on the table was immediately devoured!?
Which brings me neatly around to a favourite summertime dessert
LE peach tart, a feast for the eyes, and super quick and easy to put together.These are more photos taken by Ella, great pictures in a not so pretty baking tin, plus the tart was left a few minutes too long in the oven, but hey!? these things happen... and there was definitely no tart left by the end of the meal so it can't have been that bad!
To make a peach tart for a bunch of hungry teenagers, first make a delicious sweet pastry, I'm sure you have your favourite recipe, I like mine rich in butter, sugar and maybe some ground almonds.
If you are feeling like a saint, you'll blind-bake your pastry base.? This is a good investment of time, because the peach gets so juicy, if the pastry isn't pre-cooked, it will just go soggy.
While the pastry is in the oven, pour yourself a glass of wine, press PLAY on anything by Bob Marley and wash and slice your peaches.? I don't even skin them, because the fruit looks prettier with the skin still on (even if you go for this year's fashionable char-grilled look !!)
Take the pastry out of the oven , choose another CD,? sprinkle a little sugar over the base, quickly arrange the slices of peach, sprinkle more sugar and pop the whole lot into the oven.
Keep an eye on the tart? because there is a danger of it - ahem - caramelising.? I'd say about half a CD and two glasses of wine and the tart will be done!
Voil?? - I hope you also have some happy carefree moments to remember from the summer.? Thank you for reading me!

Protein linked to increased risk of heart failure and death in older adults
ScienceDaily (Aug. 29, 2012) ? A protein known as galectin-3 can identify people at higher risk of heart failure, according to new research supported by the National Heart, Lung, and Blood Institute (NHLBI), part of the National Institutes of Health. This research is based on work from the NHLBI's Framingham Heart Study, which began in 1948 and has been the leading source of research findings about heart disease risk factors.
Heart failure occurs when the heart cannot fill with enough blood and/or pump enough blood to meet the body's needs. Galactin-3 has recently been associated with cardiac fibrosis, a condition in which scar tissue replaces heart muscle, and cardiac fibrosis plays an important role in the development of heart failure.
Heart failure carries enormous risk for death or a lifetime of disability and often there are few warning signs of impending heart failure. Measuring levels of galectin-3 in the blood may offer a way to identify high-risk individuals who could benefit from treatments to prevent debilitating heart failure and death. Early identification of predisposed individuals would allow treatment to begin long before heart failure develops and could help people at high risk for heart failure to live longer, more active lives.
Galectin-3 levels were measured in 1996-1998 as part of a routine examination of 3,353 participants enrolled in the Offspring Cohort of the Framingham Heart Study. At the time of measurement the average age of the participants was 59 years old. During an average follow-up of 11 years, 166 participants (5.1 percent) had a first heart failure event. Among the 25 percent of people with the highest galectin-3 levels (ranging from 15.4 to 52.1 nanograms per milliliter) the annual rate of heart failure was 12 per 1,000 people compared with 3 per 1,000 people for the 25 percent of participants with the lowest galectin-3 levels (ranging from 3.9 to 12 nanograms per milliliter). Fifty-three percent of participants were women.
Spironolactone and other related drugs believed to counteract cardiac fibrosis have been shown to improve outcomes in heart failure patients. Future research will be needed to determine whether treatment with these or other drugs can benefit healthy patients with elevated galectin-3 levels.

Is Motorola announcing a Intel Medfield-powered phone on September 18th?
Our calendar in September is starting to fill up rather rapidly, with Motorola asking us to come to its second announcement in a month on September 18th. Intel's co-signed the ticket, with the partnership offering to "take us to the edge" for an exciting announcement from the pair. We're kinda assuming it's got something to do with Santa Clara's mobile chip offerings, since the companies teamed up for a "multi-year, multi-device" partnership in January that promised fresh hardware from the pair arrive in the second half of 2012.

93% Farewell, My Queen
If you are expecting a French film chronicling the last days of Marie Antoinette, then you may be in for a slight disappointment. Brilliantly directed by the Benoit Jacquot (who also co-wrote the much less impressive script) and starring Diane Kruger as Marie Antoinette and Lea Seydoux, who plays one of the Queen's readers named Sidonie Laborde, and is also the protagonist of this film (for some reason) "Farewell, My Queen" is advertised as the story of the last days of Marie Antoinette, but it's more like the somewhat muted story of the two months before the "last days" of Marie Antoinette. So, even though "Farewell, My Queen" is a better movie than Sofia Coppola's ill advised, indie rock inspired, "Marie Antoinette", due to the faux-final-days story structure, in conjunction with the fact that "Farewell, My Queen" uses Marie Antoinette as a side character, telling the story from the point of view of Sidonie Laborde (a nobody) this is a film which may have many audiences scratching their heads as to why the need to show this particular moment in the life of Marie Antoinette. As I alluded to above, "Farewell My Queen" chronicles a miniscule portion in time during the last months of Marie Antoinette's reign. However, audiences are not treated to "the good part", or the part they undoubtedly came to see. What I mean by this is there are almost no visuals of the actual Revolution, plus (and more importantly) we don't actually get to witness the final days of Marie Antoinette's life simply because "Farewell, My Queen" curiously plays out through the eyes of one of her ladies-in-waiting. Instead, audiences are forced to sit through a pseudo-love story that focuses not on the very interesting end of Marie Antoinette's reign, but on the minutiae right before it! This film is the equivalent of sitting through the love story of Jack and Rose, with the movie ending just before the Titanic strikes the iceberg. Yes, I am aware that this is a script which was adapted from a critically acclaimed novel by Chantal Thomas, BUT it still doesn't make the story's focus any less misguided. I mean, there are some scenes which do attempt to create a somewhat intriguing love story, an aspect which must be fully accredited to some fantastic mood setting by Jacquot, but in the same vein, this film never rises above said simplistic love story. Side Note: Another issue many audiences will likely come across is how frivolously "Farewell, My Queen" throws its viewers right into the deep end of this story, with little exposition. In fact, the greatest individual flaw which hinders "Farewell, My Queen" will be seen in the audiences immediate realization that neither Jacquot's visuals or the engaging performances (which I will speak about later) are going to give those not formally versed in the players of the French Revolution and the fall of Versailles, the background information they may desperately desire, as this film half-introduces more and more characters of seeming importance. So, do yourself a favor, if you are going to see "Farewell, My Queen" (at the very least) peruse the Marie Antoinette Wiki page before going to see this film. With that said, the visuals (the set design in conjunction with the director) are somewhat breathtaking at times, due to Jacquot making some very brave directorial choices, including tons of long takes which trail behind characters as they weave in and out of crowds, giving audiences an intimate feeling of the atmosphere of late 1700's France, and a few beautifully constructed shots of the landscapes. And I guess it doesn't hurt that the two female leads, Seydoux and Kruger, both give engaging performances. But even if Kruger's interpretation of Antoinette is one of the best I've ever seen and Seydoux is so captivating to watch as she effortlessly takes control of the movie every time she is on screen, there is simply not enough in the story or the writing to give reasoning to the eccentric behavior or motives behind the actions of Marie Antoinette or (more importantly) give a reason as to why Sidonie is so infatuated with her. So, even though, in the latter half of the film (more than an hour in) Jacquot does create an atmosphere which allows these characters to somewhat blossom, many will find it hard to care about a Marie Antoinette story that contains no beheadings. Final Thought: Based on a "last days" plot which attempts to imitate a much better film like "Downfall", even with some spectacular direction and two engaging female performances, "Farewell, My Queen" is nothing more than this year's "My Week With Marilyn", telling a story which focuses on characters nobody really cares about, rather than simply creating a storyline around the life/last days of (in this case) Marie Antoinette. So, even if you are a Marie Antoinette fan, with the overall structure the way it is, "Farewell, My Queen" is nothing more than DVD worthy at best. US officials checking SEAL raid book for secrets
WASHINGTON (AP) ? U.S. officials said Monday that they are reviewing a copy of a soon-to-be-published account of the raid that killed Osama bin Laden, checking for leaks of classified information.
Pentagon spokesman George Little said Defense Department officials "received the manuscript and we are looking at it."
CIA spokesman Preston Golson would only say that "the CIA has a copy of the book."
The book, "No Easy Day," is scheduled for publication on Sept. 11.
The author, a former Navy SEAL who participated in the raid, did not submit the book for pre-publication review that is required by the military secrecy agreements officials say he signed.
Pentagon regulations stipulate that retired personnel, former employees and non-active duty members of the Reserves "shall use the DoD security review process to ensure that information they submit for public release does not compromise national security."
Pentagon officials say that if they determine the manuscript reveals classified information about the raid, the Pentagon would "defer to the Department of Justice."
If there is classified information in the book, the former SEAL could face criminal charges.
The publisher says the author intends to give the "majority" of the proceeds to charity, but the Justice Department could still sue to collect any future book proceeds as well.
A special operations advocacy group, Special Operations-OPSEC, which is criticizing President Barack Obama over alleged leaks and making the raid the national security centerpiece of his re-election campaign, asked the attorney general to block the book's release until the government can make sure it reveals no classified information.
In a letter released to The Associated Press, the group asked the Justice Department "to immediately seek...an injunction in federal court to prevent this book from being published and distributed" until it can be reviewed.
Justice Department spokesman Dean Boyd says the department is reviewing the letter.
Dutton announced the book's pending release last week, saying that "No Easy Day" will "set the record straight" on the bin Laden operation.
After the initial burst of publicity, the book shot up to the top of the Amazon.com chart, reaching No. 1 as of late Friday morning and remaining there Monday, displacing the million-selling erotic trilogy "Fifty Shades of Gray."

Two of 3 tank fires extinguished at Venezuela refinery
PARAGUANA, Venezuela (Reuters) - Firefighters have managed to extinguish two of three burning storage tanks at Venezuela's biggest refinery on Tuesday, officials said, as authorities aim to restart the facility by the end of the week.
President Hugo Chavez broke the news about the first tank in a series of pre-dawn Tweets. Energy Minister Rafael Ramirez later told Reuters by telephone that a blaze in a second tank had also been extinguished.
"We continue battling with our heroic firefighters from (state oil company) PDVSA," Chavez said. "With God's help, we will succeed!"
Ramirez said there was now no risk of additional storage tanks catching fire because those nearby were either empty or filled with less flammable fuels.
He told Reuters in an exclusive interview on Monday that the 645,000 barrel-per-day facility could restart operations on Friday, and that all three burning tanks would be extinguished within two days.
An explosion on Saturday at Amuay killed 48 people and pushed up U.S. fuel prices in markets that were already bullish because of a threat that Tropical Storm Isaac could disrupt refinery operations on the U.S. Gulf Coast.
Ramirez said Venezuela currently had no plans to import fuel, and that the rise in U.S. gasoline prices would not last.
The blast has spurred fresh criticism and claims of mismanagement by PDVSA. Traders say the impact on fuel markets may continue even after Amuay is up and running again. Tank farm accidents often cause problems with gasoline blending, which means PDVSA may have to boost imports.
It was one of the most deadly oil industry accidents in recent years, nearing the toll of the 1997 fire at India's Visakhapatnam refinery that killed 56, and topping the 2005 blast at BP's Texas City refinery in which 15 people died.
Chavez said at the scene on Monday that he was creating a fund worth about $23 million to help pay for clean-up operations and replace homes destroyed by the pre-dawn blast.
He said 60 new houses were ready now, 60 more would be finished soon, and a further 137 new homes would be handed over next month. Meanwhile, PDVSA has sent vehicles to move residents and their belongings to safety, as well as food and water.
Critics say neither Chavez's government nor PDVSA is likely to face any legal fallout because his allies closely control Venezuela's regulatory agencies and the justice system.

Clooney aids Obama campaign with Geneva fundraiser
GENEVA (AP) ? President Barack Obama supporter George Clooney raised almost $15 million for the re-election campaign at the actor's Los Angeles home in May. For his second act, Clooney is set to arrive Monday in Geneva, a center for international organizations and business.
Organizers expect to pull in a more modest amount of about $500,000 from U.S. donors for Obama's campaign, with many flying in to Geneva from around the world.
Americans Abroad for Obama, the event's sponsor, says on its Web site that guests are paying $15,000 per person to dine with Clooney, $5,000 for a photo with him and $1,000 to attend a reception before the dinner. About 30 people are attending the dinner, with about 100 at the reception.
The event is co-hosted by Geneva-based American lawyer Charles C. Adams Jr. and Matthew Barzun, Obama's campaign finance chairman.

Roberts told viewers in July that she has MDS, a blood and bone marrow disease once known as preleukemia.
She says she will be hospitalized next week to prepare for the bone marrow transplant that will take place about 10 days after that.
But looking further ahead, Roberts noted she is luckier than many workers who become ill. She says her bosses have been generous in giving her the needed time off, and her job is waiting for her when she's well enough to return. She described herself as "very blessed."

Syrian helicopter downed in Damascus clashes
BEIRUT (AP) ? A Syrian military helicopter caught fire and crashed Monday after it was apparently hit during fighting between government forces and rebels in the capital Damascus, an activist group said.
State-run media confirmed the crash in Damascus but gave no details. A video posted on the Internet showed the chopper engulfed in flames shortly before it hit the ground.
The Britain-based Syrian Observatory for Human Rights, which reported the crash, said there was intense fighting between troops backed by helicopter gunships and rebels in the western Damascus neighborhood of Jobar. State media said the chopper crashed in al-Qaboun district, which is close to Jobar.
